Terms of Service

1. Acceptance of Terms
By accessing or using Sendful (the "Service"), available at sendful.ai, you agree to be bound by these Terms of Service ("Terms"). The Service is operated by Adapter Labs LLC ("we", "us", or "our"). If you do not agree to these Terms, you may not use the Service.
We reserve the right to update or modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service with a new effective date. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.
2. Account Terms
To use certain features of the Service, you must create an account. When you create an account, you agree to provide accurate, current, and complete information and to keep that information up to date.
You are responsible for maintaining the security of your account credentials. You are fully responsible for all activities that occur under your account. You must notify us immediately if you become aware of any unauthorized use of your account.
You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account and use the Service.
3. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service to violate any applicable law, regulation, or the terms of any third-party platform you connect to the Service.
- Post, publish, or distribute content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
- Attempt to gain unauthorized access to the Service, other accounts, computer systems, or networks connected to the Service.
- Use the Service to send spam, unsolicited messages, or engage in any form of automated abuse.
- Reverse engineer, decompile, or disassemble any part of the Service.
- Interfere with or disrupt the integrity or performance of the Service.
We reserve the right to suspend or terminate your access to the Service if we determine, in our sole discretion, that you have violated these Terms.
4. Your Content
You retain ownership of all content you submit, post, or display through the Service ("Your Content"). By using the Service, you grant us a limited, non-exclusive, worldwide license to use, store, and process Your Content solely for the purpose of providing the Service to you.
You represent and warrant that you own or have the necessary rights and permissions to use and authorize us to use Your Content as described in these Terms.
5. Intellectual Property
The Service and its original content (excluding Your Content), features, and functionality are and will remain the exclusive property of Adapter Labs LLC and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
6. Third-Party Platforms
The Service allows you to connect to and interact with third-party social media platforms. Your use of those platforms is governed by their respective terms of service and privacy policies. We are not responsible for the practices of any third-party platform.
7. Payment and Billing
Certain features of the Service may require a paid subscription. By subscribing to a paid plan, you agree to pay the applicable fees. All fees are non-refundable except as required by law or as expressly stated in these Terms.
We may change our pricing at any time. If we change the pricing for your subscription, we will notify you at least 30 days before the change takes effect. Your continued use of the Service after the price change constitutes your agreement to the new pricing.
8. Termination
You may terminate your account at any time by contacting us or using the account settings within the Service. We may terminate or suspend your account and access to the Service at any time, with or without cause or notice.
Upon termination, your right to use the Service will immediately cease. We may delete your account data within a reasonable time after termination, subject to any legal obligations to retain such data.
9. Disclaimers
The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, secure, or error-free. We do not guarantee any specific results from the use of the Service, including follower growth, engagement, or reach on any third-party platform.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Adapter Labs LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.
In no event shall our total liability exceed the greater of one hundred US dollars ($100) or the amount you have paid us in the twelve months preceding the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless Adapter Labs LLC and its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Delaware, and you consent to the jurisdiction of such courts.
13. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms will otherwise remain in full force and effect.
